Migma.ai provides an AI-powered email creation platform that allows users to generate professional, on-brand emails. The specific features and functionality of the Services may change from time to time.

3. Eligibility and Account Creation

To use certain features of the Services, you may need to create an account. You may create an account using Google Sign-in or another method we provide. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account, including keeping your password confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

If you create an account using Google Sign-in, you also agree to comply with Google's terms of service and privacy policy. We reserve the right to terminate your account at any time for any reason without notice.

4. Google Sign-In

Our Services allow you to sign in using Google. By choosing to use Google Sign-in, you authorize us to access and use certain Google account information in accordance with our Privacy Policy and Google's terms of service. This information may include your name, email address, and profile picture.

When using Google Sign-in, you are subject to Google's terms and policies in addition to these Terms. We are not responsible for Google's acts or omissions, including changes to their services or policies.

As detailed in our Privacy Policy, we only use Google user data for providing and improving our Services. We do not use this data for advertising, selling to third parties, or other prohibited purposes outlined in our Privacy Policy. 5. User Content and Conduct

7. Payment Terms

We may offer paid services or features. If you choose to purchase such services or features, you agree to pay all applicable fees. All fees are non-refundable unless otherwise stated.

We may change our fees at any time. If we change our fees, we will provide notice of the change on the website or by email, at our discretion. Your continued use of the paid services after the fee change becomes effective constitutes your agreement to pay the changed amount.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MIGMA.AI, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

10. Indemnification

You agree to defend, indemnify, and hold harmless Migma.ai, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

11. Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the jurisdiction in which Migma.ai is established, without regard to its conflict of law provisions.

12. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall be resolved through good faith negotiations. If such negotiations do not resolve the dispute, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

13. Termination

We may terminate or suspend your access to all or part of the Services, without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms or is harmful to other users of the Services, to us, or to third parties, or for any other reason.

14. Third-Party Services

The Services may contain links to third-party websites or services that are not owned or controlled by Migma.ai. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. By using the Services, you expressly relieve Migma.ai from any and all liability arising from your use of any third-party website or service.

Your interactions with organizations and/or individuals found on or through the Services, including payment and delivery of goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such organizations and/or individuals.
